Welcome to Blabify! These Terms of Service ("Terms") govern your use of the Blabify mobile application and related services (collectively, the "Service") operated by Blabify ("we," "us," or "our").

By downloading, installing, or using Blabify, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that:

  • You are at least 13 years of age (or the minimum age required in your jurisdiction)
  • You have read, understood, and agree to be bound by these Terms
  • You have read and understood our Privacy Policy
  • If you are using the Service on behalf of an organization, you have authority to bind that organization to these Terms

2. Description of Service

Blabify is a social listening platform that allows users to:

  • Create and join virtual "rooms" for shared music listening
  • Synchronize Spotify playback across multiple users
  • Communicate via real-time voice "drops"
  • Collaboratively manage a music queue

2.1 Spotify Integration

Blabify integrates with Spotify to provide its core functionality. You must have a valid Spotify account to use Blabify. Your use of Spotify is subject to Spotify's Terms of Service.

2.2 Spotify Premium Requirement

Full playback functionality (play, pause, skip, seek) requires Spotify Premium. Users with free Spotify accounts may have limited functionality.

3. User Accounts

3.1 Authentication

Blabify uses Spotify's OAuth system for authentication. We do not create separate user accounts—your Spotify account serves as your identity within Blabify.

3.2 Account Responsibility

You are responsible for:

  • Maintaining the security of your Spotify account
  • All activity that occurs through your use of Blabify
  • Notifying us immediately if you suspect unauthorized use

4. User Conduct

You agree not to use the Service to:

4.1 Prohibited Content

  • Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
  • Share content that promotes discrimination, bigotry, racism, hatred, or harm against any individual or group
  • Distribute sexually explicit or pornographic material
  • Share content that exploits minors in any way

4.2 Prohibited Actions

  • Harass, intimidate, or threaten other users
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any illegal purpose
  • Circumvent any access restrictions or usage limits
  • Use automated means (bots, scrapers) to access the Service
  • Reverse engineer, decompile, or disassemble the Service

4.3 Room Conduct

  • Respect room hosts and their moderation decisions
  • Do not spam the voice drop feature
  • Do not monopolize the queue with excessive song additions
  • Be respectful in voice communications

5. Intellectual Property

5.1 Our Intellectual Property

The Service, including its original content, features, and functionality, is owned by Blabify and is protected by international copyright, trademark, and other intellectual property laws.

5.2 Music Content

All music content accessed through Blabify is owned by the respective artists, labels, and rights holders. Blabify does not claim any ownership of music content—we facilitate access through the Spotify API in accordance with their terms.

5.3 User Content

Voice communications transmitted through Blabify are not stored or recorded. By using the voice drop feature, you represent that you have the right to share any content you transmit.

6. Rooms and Moderation

6.1 Room Hosts

The user who creates a room is the "host." Hosts have additional privileges including:

  • Control over playback (play, pause, skip)
  • Ability to remove songs from the queue
  • Ability to manage room settings

6.2 Room Codes

Room codes should be shared responsibly. You are responsible for who you share your room code with.

6.3 Reporting

If you encounter inappropriate behavior or content, please report it to support@blabify.app.

7. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Third-Party Services

8.1 Spotify

Blabify relies on Spotify's API. Your use of Spotify through Blabify is subject to Spotify's terms and policies. We are not responsible for:

  • Changes to Spotify's service or API
  • Spotify account issues or restrictions
  • Content availability on Spotify

8.2 Voice Communication

Voice messaging uses our store-and-forward system via Socket.IO. Connection quality depends on network conditions. Voice messages are temporarily buffered for delivery and immediately deleted after playback.

9. Disclaimers

9.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantee

We do not guarantee that:

  • The Service will be uninterrupted, secure, or error-free
  • Playback synchronization will be perfect in all conditions
  • Voice communication will work without latency or issues
  • The Service will meet your specific requirements

9.3 Network Dependency

Blabify requires an internet connection. We are not responsible for issues caused by your network connectivity or your internet service provider.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLABIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Service
  • Any unauthorized access to or use of our servers
  • Any interruption or cessation of transmission to or from the Service
  • Any bugs, viruses, or other harmful code
  • Any content or conduct of any third party on the Service

11. Indemnification

You agree to indemnify and hold harmless Blabify and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your voice communications through the Service

12. Termination

12.1 By You

You may stop using the Service at any time. You can also revoke Blabify's access to your Spotify account through Spotify's account settings.

12.2 By Us

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Conduct that we believe is harmful to other users or the Service
  • If required by law
  • At our sole discretion

12.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination will survive.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by:

  • Posting updated Terms on this page
  • Updating the "Last updated" date
  • Providing in-app notification for significant changes

Your continued use of the Service after changes indicates acceptance of the modified Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15. Dispute Resolution

15.1 Informal Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@blabify.app.

15.2 Arbitration

Any disputes not resolved informally shall be resolved through binding arbitration, except that either party may bring claims in small claims court if eligible.

15.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Blabify regarding the Service.
